We point out an important ruling by the Consiglio di Stato (Cons. State Sec. V nr. 4089/2023) about being awarded in public tenders for ISO certifications issued by certification bodies registered in England.
The Supreme Administrative Court confirmed that such certifications are no longer valid in the European Union and, as a consequence, cannot be used to obtain points in public procurement procedures.
This decision is remarkable because, as reported above, the Council decided following a specific interpellation to the E.A., the European regulatory and supervisory body in the field of quality certification accreditation.
This body replied to the question by saying that after Brexit, the English accreditation body will no longer be a national accreditation body within the meaning of EC Regulation No 765/2008.
As a result of this statement, it is therefore advisable for those who intend to participate in public tenders and who rely, for the purposes of the bonus point, on certificates issued by national bodies accredited by the English body, to replace these certificates.
